Pitfalls when applying for an operator's licence
A recent Transport Tribunal case shows the importance of making sure that applications for operator’s licences are completed correctly and sent with the correct supporting documentation. Get it wrong and not only will the application be refused, but you will also have wasted valuable time and money.
When applying for a licence, make sure that the accompanying advertisement is factually correct and advertised within the statutory time frame. It needs to be advertised in a newspaper circulating in the locality. If you are at all in doubt as to whether or not your chosen publication will qualify, then seek advice. There is some useful information regarding newspaper circulation data on the Newspaper Society website.
Applicants for a standard national or standard international licence will need to be of good repute, appropriate financial standing and professionally competent. Applicants for a restricted licence must have sufficient funds so that maintenance is not compromised. For details of the new financial requirements, please see the January 2010 topic of the month. Remember that the onus is on the applicant to prove these and it may be worth seeking legal advice from the outset so that any potential problems can be addressed before the application is submitted.
